Temporary Protected Status (TPS) Justice March, Rally & Hearing

Please join us at All Saints Church at 7:00 a.m. Wednesday, August 14, as we rally and march to stop the current family separation crisis.

On August 14th the 9th Circuit Court of Appeals in Pasadena will hear Trump’s arguments to reinstate the cancellation of Temporary Protected Status (TPS) for 6 countries. We will meet on the lawn at All Saints at 7:00 a.m., and march to the Federal Building at 125 South Grand Avenue (1.5 miles), then be inside and outside the Courthouse while our lawyers argue why the preliminary injunction protecting TPS status must remain in place. The rally at the Federal Building will start at 8:30 a.m.

TPS is extended by the Secretary of Homeland Security to countries with ongoing armed conflict, an environmental disaster, or conditions preventing a safe return of its citizens home.

The Trump administration has decided to end the TPS designations for El Salvador, Haiti, Nicaragua, and Sudan.

That decision was put on hold in U.S. District Court, which found that opponents would likely prevail with their argument that the process by which the policy was adopted is not compliant with the federal Administrative Procedures Act (APA).

The administration appealed that Oct. 28, 2018, ruling and now the case, Ramos v. Nielson, is before a three-member panel at the Ninth Circuit’s Pasadena branch. The decision to terminate the status itself can not be overturned by a court, but the way in which it was arrived at can be invalidated.

If the administration does not prosper at the Ninth Circuit, which the president considers a rogue appellate banc, it could petition the U.S. Supreme Court or start over with an APA compliant protocol.

The lower court ruling was a reprieve for some 300,000 TPS holders from the aforementioned countries.
