Every week at All Saints Church we put our faith into action. This week we are sending comments to the U.S. Labor Department supporting a proposed regulation (RIN 1235-AA43) to deal with the huge problem of employee misclassification.

When employers miscategorize workers as independent contractors, they deprive them of the right to organize in the workplace, minimum wage protections, access to overtime pay, workers comp, unemployment benefits, and protection from workplace discrimination.

The Biden administration and the Department of Labor (DOL) are looking to address this problem by making it easier for millions of people categorized as independent contractors to be classified as employees.

From janitorial work to trucking to gig workers like Uber and Lyft drivers, employee misclassification is a persistent problem in our economy and is a racial justice issue. In many industries like the gig economy, workers are primarily from communities of color and are immigrants. Because of the misclassification, they are often exploited, underpaid, and left to fend for themselves with no federal or state labor standards to protect them.

The U.S. can’t keep allowing businesses to avoid tax and legal liabilities, and deny workers’ rights to benefits by misclassifying their workers as independent contractors. At its core, the new DOL rule will establish a bedrock of protections for workers, and grant federal labor protections and benefits to millions who are currently excluded because of the misclassification.
